Terms of service
Last updated: 2026-11-01
These terms cover your use of Payment Failed Recovery Abakira (“the app”), a Shopify app run by Abakira LLC (“we”, “us”). By installing the app you accept them. If you don’t, don’t install it.
1. What the app does
When a buyer’s payment is declined at your checkout, the app notices it through a web pixel and, a few minutes later, sends that buyer one email under your store’s name with a link back to their checkout. It stays silent if the buyer pays in the meantime. It never adds a discount and never sends marketing. We change features over time.
2. Plans and billing
There is a free plan with a monthly number of emails, and a paid plan. Their prices and limits are in the pricing section of the app’s page on the Shopify App Store, and in the plan page inside the app. Paid plans are billed by Shopify, through your Shopify invoice. We never see your card. You can change or cancel your plan at any time from the app; Shopify applies the change as it describes in its own billing terms. When the monthly limit of your plan is reached, further failed payments that month get no email, and the app tells you so.
3. Your responsibilities
- The emails go to your buyers, in your store’s name, and replies reach your store’s customer contact email. You make sure that sending a service message about a failed payment is lawful where you sell, and that your own privacy policy covers it.
- You keep your Shopify account secure, and you don’t use the app for anything unlawful or try to disrupt it, other merchants, or Shopify.
4. Your data
What we collect, why, and how long we keep it is in the privacy policy. It is part of these terms. You remain the controller of your store’s data, including your buyers’ data; we process it on your behalf.
5. Payments and orders
The app does not take, retry or refund payments, and does not hold funds. The buyer completes the payment on your own Shopify checkout. A declined card and a payment gateway error look the same to the app, so both get the email. We don’t promise that any buyer will come back and pay.
6. Uninstalling
You can uninstall the app at any time from your Shopify admin. No email is sent after that, and we delete what we hold for your shop as described in the privacy policy.
7. No warranty, limited liability
The app is provided “as is”. We don’t promise it will be free of errors or always available, and we don’t promise any level of sales. To the extent the law allows, we are not liable for indirect or consequential damages, such as lost sales or lost data. Our total liability for any claim is limited to what you paid us for the app in the 12 months before the claim, or $100 if you are on the free plan. Nothing here limits a liability the law does not allow us to limit.
8. Suspension and termination
We can suspend or end your access if you seriously breach these terms and don’t fix it after we tell you, or if Shopify or the law requires it. You can stop at any time by uninstalling.
9. Changes to these terms
When we change these terms, the date at the top changes. If you keep using the app after that, you accept the new version.
10. Governing law
These terms are an agreement between you and Abakira LLC. They are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws rules. Any dispute about them or about the app goes to the state or federal courts located in New Mexico, and you and we both accept their jurisdiction.
